Türkiye Cumhuriyeti’nin kuruluş felsefesinden anayasal demokrasi idealinin yansımaları

Abstract

Türkiye Cumhuriyeti’nin “Kurucu İktidarı” Osmanlı Devlet ve toplum yapısını çağdaş/modern bir devlet ve toplum yapısına dönüştürürken çeşitli hukuki süreçler yürütmüştür. Kurucu iradenin ve özellikle Atatürk’ün hedeflediği anayasal düzen, ortaya koyulan hukuki belgelerin incelenmesi suretiyle en iyi ve doğru şekilde anlaşılabilir. Bu gerçekten yola çıkarak ele alınan, 1921 Teşkilat-ı Esasiye Kanunu, 1924 Anayasası ve ulusal ya da uluslararası normatif düzenlemeler yapan hukuki belgeler, yapılan temel değişikliklerin demokrasi ideali ile örtüştüğünü göstermektedir. Milli egemenlik, demokrasi, insan haklarına saygı, temel hak ve özgürlüklerin anayasal güvencelere bağlanması, kuvvetler ayrılığı, kadın erkek eşitliği, uluslararası toplum ile barış içinde yaşama kararlılığı gibi evrensel değerler tarihsel süreç içinde yeni kurulan devletin pozitif hukukunda yerlerini almıştır. TBMM’nin kuruluşundan Atatürk’ün ölümüne kadar üzerinde çalışma yapılan sürecin totaliter devletler ve diktatöryal liderler çağı olduğu göze çarpmaktadır. Buna karşın, kurucu iktidarın hem devlet hem de toplum yapılanmasında, çağdaş anayasal demokrasi idealine uyumlu hukuki düzenlemeleri yine demokrasi anlayışıyla uyumlu yöntemler ile gerçekleştirdiği tespit edilmektedir.

"Constituent Power" of Turkish Republic has conducted various legal processes when converting the structure of Ottoman Empire and society to a contemporary and modern state. The most accurate way, to understand the aims and objectives of the founding fathers especially Atatürk’s, is to examine the legal documents which they put forward. It is observed that the amendments made by the 1921 Constitutional Structure Law, the 1924 Constitution and other basic legal documents, which made national or international normative regulations, were in accordance with the ideal of democracy. Universal values such as national sovereignty, democracy, respect for human rights, constitutional assurances of fundamental rights and freedoms, separation of powers, equality of men and women and determinations to live in peace with the international community have taken place in the legal documents of the newly established state within the historical process. From the establishment of the Turkish Grand National Assembly until the death of Atatürk, it is observed that the period of totalitarian states and dictatorial leaders was in power. Despite this, it is determined that constituent power carries out legal regulations in both state and society structuring compatible with the ideal of modern constitutional democracy with methods compatible with democracy.
